TERMS & CONDITIONS – Soft Touch Bases
PRICING AND CONDITIONS: Prices prevailing at the time of the shipment will apply on all orders. Prices are
subject to change without notice including but not limited to changes caused by fluctuations in market price,
availability, or quality of raw materials employed in the manufacturing of the Goods described herein. Buyer is
responsible for any sales tax levied thereon or additional costs due to State or Federal legislation. Soft Touch®
Bases reserves the right to reject any or all offers.
FREIGHT: Prices are FOB Origin – Zip Code 53186
Any additional shipping charges and/or surcharges incurred will be passed on to the customer.
All Residential packages are shipped “Signature Required” on UPS unless indicated differently by the Buyer.
Soft Touch® Bases is not liable for lost shipments if the “Signature Required” designation is removed.
CANCELLATIONS: Any cancellations must be made by phone with a Soft Touch® Bases representative.
Cancellations made by fax or e-mail will not be accepted.
RETURN MERCHANDISE: Returns may be made up to 30 days of purchase. Returns must be authorized by a Soft
Touch® Bases representative. Any merchandise returned without prior approval will be refused. All items must
be returned in the original condition they were received and must be shipped postage prepaid. Returns are
subject to a maximum restocking fee of up to 20%. Refunds on products will not include shipping charges. The
refund amount will be based on the condition of the product when returned. If the purchase is older than 30
days, there is no refund or exchange.
WARRANTY: Bases are warranted for one year from date of purchase against defects in material and
workmanship when used in a usual and customary manner. Warranty is void if any changes are made to the
original mounting system or not installed as per installation instructions. Proof of purchase is required in the
form of a sales order number, receipt or any other documentation that will verify when the product(s) were
purchased. Normal wear and tear of the bases is not covered. Pictures of defective merchandise are required
and the Manufacturer may request that merchandise be returned before any warranty decisions can be made.
The liability of the Manufacturer for a warranty claim is limited to either a refund of the purchase or
replacement of the defective product.
SHORTAGES: All claims for shortages, lost or damaged shipments must be made directly to the delivering
carrier. If the shortages are due to packaging error, it must be reported within 10 days of receipt for any
adjustment to be made.
DISCLAIMER: Sliding into a base may cause serious or permanent injury. No base, however constructed or
designed, can prevent all injuries. Soft Touch® bases are no exception. All players should be informed of the
risks inherent in baseball/softball play. Players by their participation assume all risks of injury. Manufacturer
advises that deviation from installation instructions or failure to properly maintain bases and properly groom
playing surfaces around bases could increase the risk of injury to players.
INDEMNIFICATION: Buyer agrees to indemnify and hold Seller and its officers, agents, employees and insurers
harmless from any and all liabilities and expenses, including without limitation, reasonable attorney’s fees,
expenses, costs, judgments, settlements, contract losses, damages, injuries or death (including, but not limited
to, liquidated damages) or other costs actually incurred arising directly or indirectly from any alleged or actual
defects, non-conformities or breach of warranties or improper installation or use with respect to the Products.
